Consultations - Licensing Act 2003

Introduction

Below is a list of the applications under the Licensing Act 2003 that are outstanding and other licensing policy documents that the councils are currently consulting on or awaiting hearings.

These are the recently received applications for new licences/registrations and applications to vary existing licences/registrations:

All the applications and policy documents can be viewed in full at the Licensing Unit. All licensing hearings are held, in public, at the Shoreham Centre or Worthing Town Hall unless otherwise noted.

Under the Act minor variation applications cannot be dealt with at hearing but for:

  • new premises licence applications
  • new club premises certificate applications
  • full variations to existing licences

For those that receive relevant representations from 'responsible authorities' and/or any other person, and mediation is unsuccessful or impractical, a hearing is required.

A summary of all the applications recently dealt with for:

All relevant representations received regarding a Licensing Act 2003 application will be forwarded unredacted to the applicant as required by the Licensing Act 2003 (Hearings) Regulations 2005 and the Guidance issued under section 182 of the Licensing Act 2003 (December 2023) issued by the Home Office. This will include a representor's name, address and contact details. The Licensing Act 2003 encourages mediation and an applicant will be encouraged to contact representors directly to discuss the application and mediate.
 
It is an offence knowingly or recklessly to make a false statement in connection with an application made under the Licensing Act 2003 and the maximum fine for which a person is liable is £5,000 on summary conviction for the offence.

Applications - Adur

New Premises Licence at:
The Corner Shop

An application for a new premises licence at the 'Corner Shop'. The new convenience store to be situated at 87 South Street, Lancing, West Sussex, BN15 8AP.

The application sought authorisation for the sale of alcohol for consumption off the premises.

  • Alcohol sales:
    • 07:00hrs to 23:00hrs Monday - Sunday
  • Opening to the public:
    • 07:00hrs to 23:00hrs Monday - Sunday

The applicant offered a set of conditions to address the licensing objectives.

Licence holder and applicant: New President Ltd.

Consultation closes: Wednesday 6 May 2026

Committee Hearing: Cancelled, not required.

Consultation on this application resulted in no relevant representations being received from the public. However, one representation was received from a Responsible Authority (Sussex Police).

The Licensing Act encourages mediation, and this was conducted between the applicant and Sussex Police with the applicant addressing the representor's concerns by volunteering a number of enforceable conditions to the licence's operating schedule. As a result, the representation was withdrawn and consequently, the amended application was granted as per the terms of the Licensing Act.

New Premises Licence at:
Padel Republic

An application for a new premises licence at 'Padel Republic'. The sports centre is situated at the Old Aggregate Yard (Fisherman's Wharf) Brighton Road, Shoreham-by-Sea, BN43 6RN

The premises comprise an indoor padel sports facility located within a commercial area, consisting of multiple enclosed padel courts, a reception area, changing facilities and a café/bar area with seating for players and spectators.

The application is seeking authorisation for the sale of alcohol for consumption on the premises:

Miint

An application for a new premises licence for a proposed new internet based artisan hamper gift business to be known as Miint. The business to be situated at 51 Greenways Crescent, Shoreham-by-Sea, West Sussex, BN43 6HR 

The business is proposing to sell/supply artisan hampers that can contain alcohol (local wines & spirits) as an incidental to local foods stuffs. All sales will be via online & phone orders with delivery only. Customers will not be able to attend the premises.    

The application is seeking authorisation for sale of alcohol for consumption off the premises:

  • Sale of alcohol:
    • 00:00hrs to 00:00hrs (24hrs a day) Monday - Sunday for internet orders. Goods dispatched during daytime hours only

Applications - Worthing

New Premises Licence at:
Babylon

An application for a new premises licence for a new café-bar to be called Babylon. The venue to be situated at 6-8 New Street, Worthing, West Sussex, BN11 3BT.

This premises had historically been licensed as a restaurant and more recently as a café-bar.

The application sought authorisation for the sale of alcohol for consumption on & off the premises, the provision of regulated entertainment in the form of recorded music, and provision of late-night refreshment:

  • Supply of alcohol (on & off the premises):
    • 11:00 to 01:00 hrs, of the following morning, Sunday - Wednesday
    • 11:00 to 02:00 hrs, of the following morning, Thursday & Friday
    • 11:00 to 02:15hrs, of the following morning, Saturday
  • Recorded music:
    • 11:00 to 01:00 hrs, of the following morning, Sunday - Thursday
    • 11:00 to 02:15 hrs, of the following morning, Friday & Saturday
  • Late night refreshment (indoors):
    • 23:00 to 01:00 hrs, of the following morning, Sunday - Wednesday
    • 23:00 to 02:00 hrs, of the following morning, Thursday - Saturday
  • Opening hours:
    • 09:00 to 01:30 hrs, of the following morning, Sunday - Wednesday
    • 09:00 to 02:30 hrs, of the following morning, Thursday - Saturday
  • Non-standard timings:
    • All terminal hours extended by 2 hours on Xmas Eve, Boxing Day, New Year's Eve and Easter.

The applicant had offered a set of conditions to address the licensing objectives.

Consultation closes: Thursday 9 April 2026

Committee Hearing: Held on Wednesday 29 April 2026.

Consultation on this application resulted in three relevant representations being received from the public and two from responsible authorities (Sussex Police and the A&W Environmental Protection Team).

The Licensing Act 2003 encourages mediation and mediation had been partially successful with the representation from Sussex Police having been withdrawn after mediation proved successful with the applicant addressing the police's concerns and volunteering conditions to the application's operating schedule which would become enforceable conditions of any licence that might be issued.

Mediation between the applicant and the other representors did not produce any further agreements so the application was referred to a Licensing & Control Sub-Committee hearing to consider and decide as detailed above.

At the hearing the Sub-Committee considered all the written representations and heard statements from representors and the applicant. In reaching its decision the Licensing Sub-Committee gave due regard to the following:

  • The statutory licensing objectives
  • Worthing Borough Councils Statement of Licensing Policy
  • Guidance under section 182 by the Home Secretary and Licensing Act 2003
  • The application, the written representations all the statements given at the hearing

The Sub-Committee also gave regard to human rights legislation and the rules of natural justice.

It resolved that a premises licence should be granted but with amended timings:

  • Sale of alcohol:
    • 11.00 hrs to 23:00hrs Monday - Sunday
  • Opening to the Public
    • 09:00hrs to 23:30hrs Monday - Sunday

and imposed the following conditions:

  • The outside area at the front of the premises not to be included in the licence
  • The doors and windows to be kept closed from 20:30hrs each day to protect the quiet neighboured from noise nuisance
  • The licence to include the conditions (where still relevant) that were agreed with Sussex Police during mediation

The grant of the licence also subject to all the mandatory conditions required by the Licensing Act 2003 and all other relevant legislation.

The Sub-Committee had listened carefully to all the representations and the statements from the applicant. The Sub-Committee was not persuaded that the applicant would not undermine the licensing objective of the Prevention of Public Nuisance if the licence were granted as applied for. The Sub-Committee accept the evidence of Environmental Protection Team regarding complaints regarding the previous operation of this premises and heard evidence from the residents regarding previous issues with noise nuisance caused by the operation of this premises as a late night café-bar.

Whilst the Sub-Committee considered, as per the Statutory Guidance the economic benefit of this business in line with the licensing objectives as required, the members also took into account the Guidance in relation to the Prevention of Public Nuisance (Noise). The Licensing Sub-Committee believe that this decision was just and proportionate taking all the evidence into consideration.

New Premises Licence at:
Worthing Festival - Homefield Park

An application for a new premises licence for a proposed three-day public festival known as the 'Worthing Festival'. The event to be situated at Homefield Park, Newland Road, Worthing, BN11 1LB.

The event was staged successfully in June 2025 under the authority of a temporary premises licence.

The application is seeking authorisation for sale of alcohol for consumption within the park and the provision of regulated entertainments for an audience of up to 4,999 persons on up to three consecutive days over a weekend in June each year between the hours of:

  • Sale of alcohol:
    • 13:00hrs to 22:00hrs Friday
    • 11:00hrs to 21:00hrs Saturday & Sunday
  • Live music, recorded music, performance of dance & anything similar:
    • 11:00hrs to 22:00hrs Friday
    • 11:00hrs to 21:00hrs Saturday & Sunday
  • Opening to the public:
    • 11:00hrs to 22:30hrs Friday
    • 11:00hrs to 21:30hrs Saturday & Sunday

The application includes a comprehensive operating schedule to address the licensing objectives.

This application has had to be reapplied for after the original application made in March was rejected for failure to advertise in accordance with the regulations.

Licence holder and applicant: Worthing Festival CIC.

This year's festival is scheduled for 19-21 June 2026.

Londis - Chapel Road

An application for a new premises licence at a new 'Londis' store. The proposed new convenience store to be situated at units 1 & 2 Barclays Bank Building, Chapel Road, Worthing, West Sussex, BN11 1EY.

Currently the applicant, Mr Singh, is the licence holder at no. 1 Barclays Bank Buildings - a long established convenience store known as Chapel News. The new premises licence sought is for a substantially extended store knocking through into the empty retail unit next door.

The application is seeking authorisation for the sale of alcohol for consumption off the premises.

Minor Variation to the Premises Licence at:
The Moon By Sea

An application for a 'minor variation' to the premises licence at 'The Moon By Sea'. The venue is situated at Unit 2, 28 Goring Road, Worthing, West Sussex, BN12 4AD. The premises licence authorises alcohol for consumption on and off the premises.

The application seeks to vary the licence to remove the following condition of licence:

  • Under 18s will not be permitted on the premises after 21:00hrs.

And replace it with the following:

  • No under 18s past 9pm unless they are the children of the Premises Licence Holder or Designated Premises Supervisor or it is a private event.

No other changes are proposed.

Committee Hearing: Not required for a minor variation.

For a minor variation application, in addition to the statutory 10 working day public consultation, the Licensing Authority has the discretion to consult any responsible authorities it considers necessary and relevant to the type of application. In this case, Sussex Police, WSCC Fire & Rescue Service and the A&W Environmental Health Team were consulted.
