Introduction

Below is a list of the applications under the Licensing Act 2003 that are outstanding and other licensing policy documents that the councils are currently consulting on or awaiting hearings.

These are the recently received applications for new licences/registrations and applications to vary existing licences/registrations:

All the applications and policy documents can be viewed in full at the Licensing Unit. All licensing hearings are held, in public, at the Shoreham Centre or Worthing Town Hall unless otherwise noted.

Under the Act minor variation applications cannot be dealt with at hearing but for:

  • new premises licence applications
  • new club premises certificate applications
  • full variations to existing licences

For those that receive relevant representations from 'responsible authorities' and/or any other person, and mediation is unsuccessful or impractical, a hearing is required.

All relevant representations received regarding a Licensing Act 2003 application will be forwarded unredacted to the applicant as required by the Licensing Act 2003 (Hearings) Regulations 2005 and the Guidance issued under section 182 of the Licensing Act 2003 (December 2023) issued by the Home Office. This will include a representor's name, address and contact details. The Licensing Act 2003 encourages mediation and an applicant will be encouraged to contact representors directly to discuss the application and mediate.
 
It is an offence knowingly or recklessly to make a false statement in connection with an application made under the Licensing Act 2003 and the maximum fine for which a person is liable is £5,000 on summary conviction for the offence.

Applications - Adur

New Premises Licence at:
Cafe Zio

An application for a new premises licence at 'Cafe Zio'. The established café is situated at 2 Tarmount Lane, Shoreham-by-Sea, West Sussex, BN43 6DA.

The application sought authorisation for the sale of alcohol for consumption on & off the premises.

One relevant representation was received during the consultation - from Sussex Police.

The Licensing Act encourages medication, and this was conducted between the applicant and Sussex Police with the applicant addressing the representor's concerns by volunteering a number of enforceable conditions to the licence's operating schedule. As a result, the representation was withdrawn and consequently, an amended application was granted as per the terms of the Licensing Act 2003.

Variation to the Premises Licence at:
The Castle

An application for a 'full variation' to the premises licence at the 'Castle' public house. The venue is located at 7 The Strand, Worthing, West Sussex, BN12 6DL.

The premises licence authorised the sale of alcohol for consumption on & off the premises, the provision of regulated entertainment (in the form of live music, recorded music and & anything similar) and the provision of late-night refreshment.

  • Extend the Non-Standard hours for Christmas Eve, Christmas Day, Boxing Day, New Year's Day, Spring and August bank Holidays, Good Friday, Easter Sunday, Easter Monday, the proceeding and preceding day at a Bank holiday, St George's and St Patrick's Day and any other publicly declared bank holiday.
  • Remove the condition of licence that states:
    • All regulated entertainment provided at the premises (excluding recorded music) to end at 23:00 hours.
  • Add the following enforceable conditions to the licence:
    • A dispersal policy will be drawn up and implemented to ensure that as far as practicable customers leaving the premises at the end of each night's trading session do so quickly and quietly. The policy will be disseminated to staff as required to ensure that it is properly implemented, and a copy kept at the premises for inspection or other responsible authority officers on request.
    • When regulated entertainment is provided at the premises, noise checks will be carried out at the nearest noise sensitive property. A noise check log of these checks will be kept and maintained at the premises. As a minimum the log will record the date and time of the check, the name of the person making the check, the sound level and if required, any action taken. The log will be made available to an authorised officer upon request.

All other terms of licence to remain unchanged.

Licence holder and applicant: Greene King Brewing & Retailing Ltd.

Committee Hearing: Held on Wednesday 11 February 2026

Consultation on this application resulted in three relevant representations being received. One from a local resident, and two from the responsible authorities. These being Sussex Police and the A&W Environmental Protection Team.

The Licensing Act encourages mediation and this was embarked on but was only partially successful and therefore the application was referred to a Licensing & Control Sub-Committee to consider and decide.

At the hearing the Sub-Committee considered all the written representations and heard statements from the applicant.

It resolved that a premises licence should be granted as applied for and to include the conditions that were agreed with Sussex Police and the A&W Environmental Protection Team during mediation with the applicant.

The Sub-Committee considered carefully the evidence before them. Members noted that there had been two representations from the responsible authorities namely Sussex Police and Environmental Protection, however, these had now been withdrawn as a result of additional conditions agreed as part of the mediation.

There was one representation from a member of the public who was not present at the hearing to answer any questions. These objections related to litter, noise outside and antisocial issues. There was no evidence provided for the Licensing Sub-Committee to consider and therefore accepted that the variation to the licence would continue to promote the licensing objectives.

Review of the Premises Licence at:
Best One

An application for a review of the premises licence at 'Best One' under section 51 of the Licensing Act 2003. The store is situated at 92 Brighton Road, Worthing, BN11 2EN.

The convenience store's premises licence permits the sale of alcohol, for consumption off the premises, between 08:00hrs and 23:00hrs Monday to Sunday.

The application was submitted by West Sussex County Council Trading Standards Service, a responsible authority under the act, and requests that the Licensing Authority considers:

  • Suspension of the licence for a period of three months;
  • Removal of the Designated Premises Supervisor (DPS); and
  • Imposing a set of new licence conditions.

The grounds for the review being the applicant's contention that the following licensing objectives have been undermined by the carrying on of licensable activities:

  • The prevention of crime and disorder
  • The protection of children from harm

by the poor management of these premises culminating in the sale of alcohol to a person under 18 years of age during a test purchase operation.

An application for a Review of a Premises Licence, once accepted by the Licensing Authority, must in every case be referred to a Licensing & Control Sub-Committee to consider.

At the hearing the Sub-Committee carefully considered all the written & oral representations from the applicant, the representors and licence holder.

It resolved that the premises licence should be suspended for a period of 8 weeks and the conditions recommended by the applicant and agreed by the licence holder be attached to the licence.

In reaching its decision the Licensing & Control Sub-Committee gave due regard to the following:

  • The statutory licensing objectives
  • Worthing Borough Councils’ Statement of Licensing Policy
  • Guidance under section 182 by the Home Secretary and Licensing Act 2003. 
  • The application, written/oral representations made at the hearing and in writing.
  • The Sub-Committee also gave regard to human rights legislation and the rules of natural justice. 

In discharging its functions, the Sub-Committee did so with a view to promoting the Licensing objectives, the relevant objectives here being the prevention of crime & disorder and the protection of children from harm. 

The Committee heard evidence that since the beginning of 2025 there had been a number of incidents including:

  • The stocking of illegal vapes on display for sale within the shop for which the DPS had received a verbal & written warning and advice regarding underage sales of age restricted products.
  • Reports made to Trading Standards of underage alcohol sales to groups of teenagers gathering in the area. 
  • An unsatisfactory Trading Standatrds inspection of the store at which advice was provided in relation to prevention of underage sales and a warning given to the DPS that, as information had been received that this premises was involved in the sale of age restricted goods to children and that conditions of licence had been breached, the shop would be the subject of an underage sales test purchase by Trading Standards at some point in the future.
  • A further report received by Trading Standards of underage alcohol and vape sales from the head teacher of a local school following receipt of a parent complaint.
  • A failure of a test purchase carried out by Trading Standards involving a young Trading Standards volunteer, under the age of 18, being able to purchase alcohol without being challenged.    

The Licence holder fully accepted the mistakes that had been made and the seriousness of what had happened and provided mitigating evidence regarding events that had adversly impacted the running of the business. Documentation was also provided showing that:

  • Staff training had now taken place with all staff now trained to Personal Licence standard and licences applied for.
  • New signage was now on display reminding staff of the licensing objectives.
  • New till prompts installed.
  • The DPS has been removed and a new DPS put in place.
  • All the conditions requested by Trading Standard were accepted in full to promote the licensing objectives.
  • An electronic face scanner system had been installed to ensure the challenge 25 condition is upheld.  

In coming to its decision the Sub-Committee had regard to the Guidance from the Home Secretary issued under Section 182 of the Licensing Act 2003 (amended February 2026) which advises:

  • Where a warning has already been issued that licensing authorities should not merely repeat that approach.  A warning both verbal and in writing had been given in this case in February 2025 and September 2025 and yet the company still failed a test purchase.
  • That criminal activity that may arise in connection with licenced premises should be treated particularly seriously. 
  • That responsible authorities will use the review procedures to effectively deter such activities and crime.  If the prevention of crime objective is being undermined then revocation of the licence even in the first instance should be considered.  

Three responsible authorities had made representations requesting a 3 month suspension to the licence and removal of DPS.  The Licencing Sub Committee took into account the training that had taken place, the voluntary removal of the DPS and the steps taken to ensure the licensing objectives are not undermined again.  However, selling alcohol to children is completely unacceptable and there have been too many incidents and warnings on previous occasions.  The Licensing Sub-Committee therefore believed it proportionate and necessary to suspend the premise licence for 8 weeks to ensure that the licensing objectives are upheld and to act as a deterrent for other premises in the locality that these actions will not be tolerated.

Minor Variation to the Premises Licence at:
The Railway Hotel

An application for a 'minor variation' to the premises licence at 'The Railway Hotel'. The venue is located at 27 Railway Approach, Worthing, West Sussex, BN11 1UR.

The premises licence authorises the sale of alcohol for consumption on & off the premises, the provision of regulated entertainment (in the form of films, indoor sporting events, live music, recorded music, performance of dance and anything similar) and the provision of late night refreshment:

  • Alcohol sales:
    • 09:00hrs - 00:00hrs Monday to Thursday
    • 09:00hrs - 01:00hrs of the following morning Friday to Saturday
    • 09:00hrs - 22:30 hrs Sunday
  • Provision of regulated entertainment:
    • 09:00hrs - 00:00hrs Monday to Thursday
    • 09:00hrs - 01:00hrs of the following morning Friday to Saturday
    • 09:00hrs - 22:30hrs Sunday
  • Provision of late night refreshment:

The application sought to remove the following condition from the premises licence:

  • Children under the age of 18 years will only be permitted on the premises until 19:00 hours when accompanied by an adult, unless they are bona-fide hotel residents, or they are the children of the DPS or a personal licence holder who lives on site.

No other changes were sought.

Licence holder and applicant: Portabello Starboard Limited

Committee Hearing: Not required for a Minor Variation

For a minor variation application, in addition to the statutory 10 working day public consultation, the Licensing Authority has the discretion to consult any responsible authorities it considers necessary and relevant to the type of application. In this case, as it involved a proposed change to a condition of licence that could potentially impact on the licensing objectives, Sussex Police, WSCC Fire & Rescue Service and the A&W Environmental Health Team are being consulted.

In consultation with Sussex Police the applicant amended the application to amend the following condition from:

  • Children under the age of 18 years will only be permitted on the premises until 19:00 hours when accompanied by an adult, unless they are bona-fide hotel residents, or they are the children of the DPS or a personal licence holder who lives on site.

to:

  • Children under the age of 18 years will only be permitted on the premises until 21:00 hours when accompanied by a responsible adult unless they are partaking in a sit-down substantial meal with a responsible adult. All children under 18 years must vacate the premises by 22:00 hours unless they are bona-fide hotel residents, or they are the children of the DPS or a personal licence holder who lives on site.

No formal representations were received from members of the public or the authorities consulted. After due consideration officers considered the changes proposed unlikely to have an adverse effect on the licensing objectives. Consequently, the minor variation application was granted as per the terms of the Licensing Act 2003.

An application for a 'minor variation' to the premises licence at 'Factory Live'. The venue is located Unit 9a, Ivy Arch Road, Worthing, BN14 8BX.

The premises licence currently authorises the sale of alcohol for consumption on the premises and the provision of regulated entertainment (in the forms of live music, recorded music and performance).

  • Alcohol sales:
    • 12:00hrs to 23:00hrs Sunday to Thursday
    • 12:00hrs to 01:00hrs of the following morning Friday to Saturday
  • Provision of regulated entertainment:
    • 08:00hrs to 23:00hrs Sunday to Thursday
    • 08:00hrs to 01:00hrs of the following morning Friday to Saturday
  • Opening to the public:
    • 08:00hrs to 23:00hrs Sunday to Thursday
    • 08:00hrs to 01:00hrs of the following morning Friday to Saturday

The application is seeking to amend the following two conditions of licence:

  • Condition 7 which states:
    • When the premises is being used after 20:00 until close for:
      • live music and/or dancing (the definition of dancing: audience participation, disco dancing etc., as opposed to performance of dance by performers in a theatrical or arts-based setting being watched by a seated audience);
      • as a night club;
      • party or event venue;
      • with the provision of a DJ or DJs;
      • is being used as a bar or pub;
      • the event is open to the public and is not by exclusive prior invitation only (such as private weddings, birth parties etc.) then SIA door supervisors will be employed at the premises on a ratio of one per hundred persons or part thereof attending, starting with a minimum of two door supervisors, from opening or 20:00 (whichever is the later) until close.
    • Adding the following provision:
      • If the event has 80 or less attendees, then provision of door staff will be subject to the Designated Premises Supervisor’s written risk assessment.
  • Condition 10 which states:
    • No unaccompanied children under the age of 16 will be permitted on the premises after 21:00hrs. Persons under the age of 18 will be permitted on the premises after 22:00hrs when licensable activities are taking place.
    • Adding the following provisions:
      • only if the following conditions are met:
        • They are accompanied by a parent or guardian;
        • Are over the age of 14 years;
        • The event is deemed to be suitable in accordance with the venue’s risk assessment and event safety plan;
        • All persons under 18 are easily identifiable by being issued with a wristband on entry and by not being issued with a hand stamp and that this is actively policed throughout the event by door supervisors in accordance with the S.O.P. and by venue staff in accordance with the venue risk assessment and safety plan;
        • The Duty Manager and door team will be in constant radio contact throughout the event;
        • The event is not a club night;
        • A full event briefing is delivered by the Duty Manager and Head Door Supervisor before the start of the event which includes measures to ensure that persons under the age of 18 are kept safe (Age verification on entry/reminding and enforcing responsibility of parent or guardian as needed/ Challenge 25/active oversight throughout the event;
        • Staff receive regular training and reminders on how to keep children and young people safe in licensed premises and of the venue’s responsibilities under Section 11 of the Children Act 2004 and Working Together to Safeguard Children 2018 including acceptable forms of age verification procedures, prevention of purchasing or consuming alcohol, awareness of potential Child Sexual Exploitation;
        • The company contracted to provide door supervisors meets regularly with venue management to review operations and where needed in response to a specific incident;
        • All other licence conditions are met.

No other changes are proposed.

Worthing Rotary Carnival Event - Steyne Gardens

An application for a new premises licence for the 'Worthing Rotary Carnival Event'. An annual community charitable event that takes place over three days each year over the August Bank Holiday weekend and is located on Steyne Gardens, Worthing, West Sussex, BN11 3DZ.

The event has been held in the town each year for the last 103 years and includes a funfair, market and carnival procession along Marine Parade that terminates at the main site in Steyne Gardens. Where entertainment is staged in the form of dance troupes, bands, performance groups, and cultural organisations. There are a variety of food stalls, and alcohol is provided by a number of small roped-off bars.

The event has previously been run under the authorisation of Temporary Event Notices but as the popularity of the event grows this application seeks to put this on a permanent footing.
