Consultations - Licensing Act 2003

Introduction

Below is a list of the applications under the Licensing Act 2003 that are outstanding and other licensing policy documents that the councils are currently consulting on or awaiting hearings.

These are the recently received applications for new licences/registrations and applications to vary existing licences/registrations:

All the applications and policy documents can be viewed in full at the Licensing Unit. All licensing hearings are held, in public, at the Shoreham Centre or Worthing Town Hall unless otherwise noted.

Under the Act minor variation applications cannot be dealt with at hearing but for:

  • new premises licence applications
  • new club premises certificate applications
  • full variations to existing licences

For those that receive relevant representations from 'responsible authorities' and/or any other person, and mediation is unsuccessful or impractical, a hearing is required.

A summary of all the applications recently dealt with for:

All relevant representations received regarding a Licensing Act 2003 application will be forwarded unredacted to the applicant as required by the Licensing Act 2003 (Hearings) Regulations 2005 and the Guidance issued under section 182 of the Licensing Act 2003 (December 2023) issued by the Home Office. This will include a representor's name, address and contact details. The Licensing Act 2003 encourages mediation and an applicant will be encouraged to contact representors directly to discuss the application and mediate.
 
It is an offence knowingly or recklessly to make a false statement in connection with an application made under the Licensing Act 2003 and the maximum fine for which a person is liable is £5,000 on summary conviction for the offence.

Applications - Adur

New Premises Licence at:
Wolf on East

An application for a new premises licence at 'Wolf on East'. The café/delicatessen is situated at 31-32 East Street, Shoreham-by-Sea, West Sussex, BN43 5ZD.

The application sought authorisation for the sale of alcohol for consumption on & off the premises.

  • Alcohol sales:
    • 11:00hrs to 23:00hrs Monday - Saturday
    • 11:00hrs to 21:00hrs Sunday
  • Opening to the public:
    • 08:00hrs to 23:00 Monday - Saturday
    • 08:00hrs to 21:00hrs Sunday

The applicant offered a set of conditions to address the licensing objectives.

Committee Hearing: Cancelled, not required

One relevant representation regarding the application was received during the consultation - from Sussex Police.

The Licensing Act encourages mediation, and this was conducted between the applicant and Police with the applicant addressing the representor's concerns by amending the hours for the sale of alcohol to allow a 30 minute 'drinking-up time' and volunteering a number of enforceable conditions to the licence's operating schedule. As a result, the representation was withdrawn and consequently, the amended application was granted as per the terms of the Licensing Act 2003.

Applications - Worthing

Variation to the Premises Licence at:
The Castle

An application for a 'full variation' to the premises licence at the 'Castle' public house. The venue is located at 7 The Strand, Worthing, West Sussex, BN12 6DL.

The premises licence currently authorises the sale of alcohol for consumption on & off the premises, the provision of regulated entertainment (in the form of live music, recorded music and & anything similar) and the provision of late-night refreshment.

  • Alcohol sales:
    • 10:00hrs - 23:00hrs Sunday to Thursday
    • 10:00hrs - 00:00hrs (midnight) Friday & Saturday
  • Regulated entertainment
    • 18:00hrs - 23:00hrs Monday to Sunday
  • Late-night refreshment:

  • Extend the Non-Standard hours for Christmas Eve, Christmas Day, Boxing Day, New Year's Day, Spring and August bank Holidays, Good Friday, Easter Sunday, Easter Monday, the Proceeding and Preceding day at a Bank holiday, St George's and St Patrick's Day and any other publicly declared bank holiday.
  • Remove the condition of licence that states:
    • All regulated entertainment provided at the premises (excluding recorded music) to end at 23:00 hours.
  • Add the following enforceable conditions to the licence:
    • A dispersal policy will be drawn up and implemented to ensure that as far as practicable customers leaving the premises at the end of each night's trading session do so quickly and quietly. The policy will be disseminated to staff as required to ensure that it is properly implemented, and a copy kept at the premises for inspection or other responsible authority officers on request.
    • When regulated entertainment is provided at the premises, noise checks will be carried out at the nearest noise sensitive property. A noise check log of these checks will be kept and maintained at the premises. As a minimum the log will record the date and time of the check, the name of the person making the check, the sound level and if required, any action taken. The log will be made available to an authorised officer upon request.

All other terms of licence to remain unchanged.

Review of the Premises Licence at:
Best One

An application for a review of the premises licence at 'Best One' under section 51 of the Licensing Act 2003. The store is situated at 92 Brighton Road, Worthing, BN11 2EN.

The convenience store's premises licence permits the sale of alcohol, for consumption off the premises, between 08:00hrs and 23:00hrs Monday to Sunday.

The application was submitted by West Sussex County Council Trading Standards Service, a responsible authority under the act, and requests that the Licensing Authority considers:

  • Suspension of the licence for a period of three months;
  • Removal of the Designated Premises Supervisor; and
  • Imposing a set of new licence conditions.

The grounds for the review being the applicant's contention that the following licensing objectives are being undermined by the carrying on of licensable activities:

  • The prevention of crime and disorder
  • The protection of children from harm

by the poor management of these premises culminating in the sale of alcohol to a person under 18 years of age during a test purchase operation.

Minor Variation to the Premises Licence at:
Downlands - Toby Carvery

An application for a 'minor variation' to the premises licence at the 'Downlands - Toby Carvery'. The local public house & restaurant is situated at 123 Upper Brighton Road, Worthing, West Sussex, BN14 9JN. The premises licence authorises the sale of alcohol for consumption on & off the premises, the provision of regulated entertainment and the sale of late night refreshment.

The application is seeking to vary the licence to authorise:

  • Minor changes to the internal layout of the premises in accordance with plans supplied by the applicant. The changes to include:
    • Reconfiguration of fixed seating and screens
    • New wait stations as shown on the attached layout plan
    • New host station and display wall, left of main entrance
    • Removal of raised area, bottom left of plan
    • New stud wall and doors to create new bookable area
    • Blocking of door from glass wash to kitchen
    • Kitchen doors relocated and new door into carvery station
    • New display in carvery area
    • New gravy station, right of carvery
    • New UDO station, below gravy station
    • Removal of stud walls and door from old bookable area

No other changes were proposed.

Committee Hearing: Not required for a minor variation

For a minor variation application, in addition to the statutory 10 working day public consultation, the Licensing Authority has the discretion to consult any responsible authorities it considers necessary and relevant to the type of application. In this case, as it involves proposed changes to the layout of the bar & restaurant that could potentially impact on the licensing objectives, Sussex Police, WSCC Fire & Rescue Service and the A&W Environmental Health Team are being consulted.

An application for a new premises licence at 'The Comedy Rooms'. The proposed new live comedy venue is to be situated at Global House, Portland Square, Worthing, BN11 1QH.

The application is seeking authorisation for the sale of alcohol for consumption on the premises:

    • 11:00hrs to 23:00hrs Sunday
