Industrial air pollution prevention and control

About industrial air pollution

Industrial Air Pollution is controlled by The Environmental Permitting (England and Wales) Regulations 2010. The Regulations provide a framework for the operators of polluting processes (their sites are termed 'installations') to apply to the Local Authority or the Environment Agency in order to obtain a permit to operate. The Processes covered by the regulations (ranging from simple dry cleaners to huge power stations) are specified in Schedule 1 of the Regulations. The activities are classified as follows:

  • Part A(1): Large, potentially highly polluting activities. These are regulated by the Environment Agency.
  • Part A(2): Medium sized processes regulated by Local Authorities for various aspects of their operations, including emissions to land, water and air, energy and raw materials usage, waste minimisation, accident prevention and noise emissions.
  • Part B: Smaller, less energy intensive activities regulated by Local Authorities, controlling emissions to air only.

It is the role of the Public Health & Regulation Team to issue permits for installations that fall within the regime within the area. Such permits contain conditions to control the way the installation operates and set emission standards or pollution levels. Once a permit has been issued, the operator must comply with the conditions. The operator must pay an annual charge which covers the local authority costs of checking that the permit is complied with. Local authorities risk-rate the installations as high, medium or low risk, based on:

  • what the environmental impact would be if something went wrong
  • how compliant and effective the operator of the installation is

The annual subsistence charge is reduced for low and medium risk installations.

The installations are routinely inspected according to an inspection programme based on the risk rating of the installation. Breaches of the conditions can result in enforcement action. We generally try to work with operators to solve problems, and only use tough measures as a last resort.
